SCREENING ORDER. Ordered that within 30 days of when this order is issued (04/21/2023), Plaintiff must show cause, in writing, as to why this case should not be dismissed as duplicative of claims encompassed in the First Case (Case No. 3:22-cv-00543-MMDCLB). It is further ordered that, within the same timeframe, Plaintiff may alternatively voluntarily dismiss this case if he agrees that his assertions herein are in fact duplicative as noted. ORDER - It is therefore ordered that the application to proceed in forma pauperis (ECF No. #1 ) is denied without prejudice. It is further ordered that Plaintiff has until April 21, 2023, to either pay the full $402 filing fee or file a new fully complete application to proceed in forma pauperis with all three required documents as detailed herein (4/21/2023). The Clerk of the Court is directed to send Plaintiff the approved form application to proceed in forma pauperis for an inmate and instructions for the same. It is further ordered that Plaintiff will submit a complaint to this Court on or before April 21, 2023 (4/21/2023). The Clerk of the Court is directed to send to Plaintiff the approved form for filing a 42 U.S.C. 1983 complaint and instructions for the same.
