Filing 6 REPORT AND RECOMMENDATION. IT IS HEREBY RECOMMENDED that the District Judge enter an order:(1) GRANTING Plaintiff's IFP application (ECF No. #1 ); however, Plaintiff is required to pay, through NDOC, an initial partial filing fee in the amount of $16.17, within thirty days of the entry of any order adopting and accepting this Report and Recommendation. Thereafter, whenever his prison account exceeds $10, he is required to make monthly payments in the amount of 20 percent of the preceding months income credited to his account until the full $350 filing fee is paid. This is required even though it is being recommended that the action be dismissed. The Clerk should be directed to SEND a copy of any order adopting and accepting this Report and Recommendation to the attention of Chief of Inmate Services for the Nevada Department of Corrections, P.O. Box 7011, Carson City, Nevada 89702.(2) The motion for appointment of counsel (ECF No. 1-2) should be DENIED.(3) The complaint (ECF No. 1-1) should be FILED.(4) The action should be DISMISSED WITH PREJUDICE. Pending before the Court is the #3 Motion to Transfer Case to Appropriate Court's Jurisdiction, filed by Plaintiff Keith William Sullivan. Plaintiff alleges that the defendants obstructed his ability to pursue a petition for writ of habeas corpus in the Second Judicial District Court, Washoe County, Nevada. (See Compl. at 3, ECF No. #1 ). Thus, this case arises from events occurring in Washoe County, which is in this Court's Unofficial Northern Division. (Id.); LR 1A 1-6. Civil actions "must be filed in the clerk's office for the unofficial division of the court in which the action allegedly arose." LR IA 1-8. Accordingly, IT IS HEREBY ORDERED that the #3 Motion to Transfer is GRANTED. IT IS FURTHER ORDERED that the Clerk of Court shall transfer this case to the Northern Division.
