On January 9, 2024, Plaintiff filed an Amended Complaint.Title 28, United States Code, 1331, provides that "[t]he district courts shall have original Jurisdiction of all civil actions arising under the Constitution, laws, or treaties of the United States." "The presence or absence of federal-question jurisdiction is governed by the 'well-pleaded complaint rule,' which provides that federal jurisdiction exists only when a federal question is presented on the face of the plaintiff's properly pleaded complaint." Caterpillar Inc. v. Williams, 482 U.S. 386, 392 (1987).Plaintiff's Motion to Remand argues that the claims asserted in the original Complaint do not arise under federal law. ECF No. #9 . However, the original Complaint has been superseded by the Amended Complaint. See Miller v. Glanz, 948 F.2d 1562, 1565 (10th Cir. 1991) (observing that an amended complaint supersedes the original complaint).
