Pfizers motion to dismiss the False Claims Act and related state law causes of action, (Counts I, and III through XIX) is granted with leave to replead. Pfizers motion to dismiss Po lanskys claims pursuant to the FCA Retaliation provision (Count II), and the New York Whistleblower Statute (Count XXIII) is denied for the reasons stated in a separate Memorandum and Order filed today.
