May 27, 2011 Opinion or Order Filing 237 ORDER ADOPTING REPORT AND RECOMMENDATION: Before the Court is the 229 Report and Recommendation ("R & R") of the Honorable Lois Bloom, United States Magistrate Judge, dated 4/22/2011, which recommends that the Court approve the [22 1] settlement reached by the defendants and Ian Feldman, who is guardian ad litem for the plaintiff Anthony Perri. On 5/20/2011, Perri filed what purport to be objections to the R & R, which the Court will review de novo. On the merits, the Court ha s reviewed the R & R and the record and concludes that, for the reasons well stated by Magistrate Judge Bloom, the "proposed settlement is fair, reasonable, and adequate." Perri's objections, where they engage the fact and terms of the settlement, are without merit and are further evidence of the need for the appointment of a guardian ad litem. Pursuant to the attached 236 Stipulation of Settlement And Order of Dismissal, the Clerk of Court is directed to close this case. SO ORDERED by Chief Judge Carol Bagley Amon, on 5/27/2011. C/mailed. October 15, 2010 Opinion or Order Filing 199 MEMORANDUM AND ORDER: On 10/15/2010, pro se plaintiff Anthony Perri filed an 198 "Emergency Motion for a Preliminary Injunction / Tempor[ar]y Restraining Order" in the above-captioned pending case. Although he titles it as a n "Emergency Motion" and seeks immediate injunctive relief, plaintiff has neither demonstrated a likelihood of success on the merits, nor made a showing of immediate or irreparable harm. March 11, 2010 Opinion or Order Filing 179 MEMORANDUM & ORDER (ADOPTING REPORT & RECOMMENDATION): Having conducted a de novo review of the 173 Report & Recommendation, the Court is satisfied that the magistrate's approach is sensible. Accordingly, the parties' cross -motions for summary judgment (Docket Entries 137 , 142 and 145 ) are denied without prejudice. Plaintiff shall be ordered to undergo a psychiatric evaluation. The particulars of the examination, i.e., the time, place and doctor, are to be dete rmined by the magistrate judge in consultation with the parties. The plaintiff is cautioned that, should he fail to appear for such an evaluation, he risks dismissal of the complaint. If, after the psychiatric evaluation and a hearing, it is determined that plaintiff lacks the capacity to sue, a guardian ad litem will be appointed by the Court. SO ORDERED.
