Filing 47 ORDER denying in part 35 Motion for Protective Order; denying 37 Motion to Compel; denying 39 Motion for Hearing -- For the reasons set forth in the attached order, I deny plaintiff James Wooten's motion for a protective order in part but defer to the trial court any ruling about the extent to which the defendants, in litigating a motion for summary judgment or in trying the case, may make use of documents that qualify as psychotherapy notes under the applicable regulation. In additi on, I deny the plaintiff's motion to compel and the motion to appoint counsel. I direct the defendants' counsel to serve a copy of this Memorandum and Order on the plaintiff by certified mail and to file proof of service with the court no later than March 4, 2009.
