Filing 112 ORDER granting 92 and terminating as moot 104 Motion to Dismiss: granting motion to vacate order compelling arbitration 82 , 100 : For the reasons set forth in the attache Memorandum and Order, the Vatican States motion to dismiss all claims against it for improper venue based on the forum selection clauses (Doc. No. 92) is GRANTED. The Court need not decide the Vatican States motion to dismiss for lack of subject matter jurisdiction (Doc. No. 104). The joint motion submitted by plaint iff, defendant SRLLC, and defendant Colapinto to vacate this Courts August 21, 2008 Order compelling arbitration (Doc. Nos. 82, 100) is also GRANTED. The claims as between those parties will proceed in this Court. This case is recommitted to the assigned Magistrate Judge for all pre-trial matters.. Ordered by Judge Roslynn R.
