May 27, 2009 Opinion or Order Filing 26 ORDER ADOPTING REPORT AND RECOMMENDATIONS for 24 Report and Recommendations, 22 Motion for Default Judgment, filed by Maersk Line. Plaintiff's motion is granted to the extent that plaintiff is awarded liquidated damages on breach of shipping contract claims against defendant in the amount of twenty-five thousand six hundred thirty-eight dollars and seventy-five cents ($25,638.75), plus pre-judgment interest at a rate of three percent (3%) for the period from February 6, 2007 t hrough January 23, 2009, for a total amount of twenty-seven thousand one hundred fifteen dollars and fifty-six cents ($27,113.56), and that defendant's counterclaim is dismissed in its entirety with prejudice, and the motion is other wise denied. The Clerk of the Court is directed to enter judgment in favor of plaintiff in accordance with this Order and to close this case. Ordered by Judge Sandra J. Feuerstein on 5/27/2009. April 29, 2009 Opinion or Order Filing 24 REPORT AND RECOMMENDATIONS re 22 MOTION for Default Judgment: for the reasons discussed in the attached R&R, I respectfully recommend that plaintiff's motion for default judgment be granted, that a final default judgment of $27,113.56 be entered against defendant, and that defendant's counterclaim be dismissed with prejudice.
