July 16, 2012 Opinion or Order Filing 150 ORDER denying without prejudice 142 Motion for Contempt for failure to comply with Local Rule 83.6 of this Court. Plaintiff must personally serve Mr. Lukman by July 31, 2012 with a copy of its contempt motion papers in accordance with Rule 83.6 o f the Local Civil Rules which mandates that service shall be made personally, in the manner provided for by the Federal Rules of Civil Procedure for the service of a summons. Plaintiff must also serve Mr. Lukman with copies of this order, the subpoe nas previously served on him on July 9, 2009 and April 26, 2012, the text of Rule 45(c) and (d) of the Federal Rules of Civil Procedure as required by Rule 45(a) and witness fees and mileage as required by Rule 45(b)(1). The Court will issue a further order directing their compliance the subpoenas served on them and will issue a certification of contempt if they fail to do so by the deadlines set. For the reasons stated on the record, plaintiffs' motion to compel defendant to produce discovery responses is granted to the extent stated. As set forth in the minute order attached, defendant must immediately provide the authorizat ions sought and supplement her discovery responses by 2/3/10. Defendant is warned that she will be precluded from presenting any future evidence that should have been disclosed. Fact discovery is closed except as to enforcement of any discovery req uests made to date and ordered by the Court. The deadlines for expert disclosures and reports are extended as follows: plaintiffs must serve disclosures and report from their handwriting expert by 3/1/10 and defendant rebuttal expert report and disc losures are due 4/1/10; other affirmative expert reports and disclosures (plaintiffs' real estate expert and defendant's mental health expert) must be served by 1/29/10 and rebuttal disclosures and reports served by 3/1/10. Subject to furt her notice by the Court, the hearing on plaintiffs' motion for appointment of a receiver shall begin on February 24, 2010 at 2:15 p.m. and continued to February 26, 2010 at 10:00 a.m. and March 3, 2010, if necessary.
