Filing 18 MEMORANDUM AND ORDER: This case is before me on consent of the parties, pursuant to 28 U.S.C. § 636(c). (See Consent to Exercise Jurisdiction by a U.S. Magistrate Judge, dated Oct. 19, 2007.) Although the parties initially attempted to settle t he matter, defendant A to E, Inc. (defendant or A to E) never answered or moved with respect to the complaint, and plaintiffs now seek a default judgment. For the reasons stated in the attached Memorandum and Order, plaintiffs' motion is grante d, and plaintiffs are hereby awarded $1,501.39 in liquidated damages and $4,260.65 in attorney's fees and costs, for a total of $5,762.04. The Clerk of the Court is hereby directed to enter judgment for plaintiffs in the amount of $5,762.04. Ordered by Magistrate Judge Robert M. Levy on 12/21/2009. (Marino, Janine) |
