September 29, 2009 Opinion or Order Filing 35 REPORT AND RECOMMENDATION: The Court requested the complete deposition transcript of plaintiff Dario Garo, which defendant provided on 7/14/2009. As the Court refers to parts of the transcript not already on record, the Clerk of Court shall docket pl aintiff's complete deposition transcript. (See doc.# 34 ). Although the Court notes defendant's objection to paragraphs 4-6 and Exhibits B and C of plaintiff's opposition, defendant's 20 motion to strike is denied. It is respectfully recommended that defendant's motion for summary judgment should be granted. It is further recommended that for the purpose of an appeal in forma paupris, the Court should certify pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from a judgment entered herein would not be taken in good faith.
