In an abundance of caution, however, and in deference to plaintiffs pro se status, the court grants plaintiff thirty (30) days to amend his complaint. The amended complaint must be captioned as an "Amended Complaint" and bear the same docket number as this Order. For the convenience of pro se plaintiff, the court has attached Instructions on How to File an Amended Complaint. No summonses shall issue at this time and all further proceedings shall be stayed for thirty (30) days. If plaintiff fails to amend his complaint within thirty (30) days of the entry of this Order, i.e., by April 14, 2009, the court will dismiss this complaint. The court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal.
