Filing 15 MEMORANDUM AND ORDER. For the reasons enumerated in the attached document, Petitioner's sentence imposed pursuant to the N.Y. Persistent Felony Offender Statute, P.L., sec. 70.10, did not violate Petitioner's Sixth Amendment rights to trial by jury. Accordingly, the petition for the writ of habeas corpus is denied. The Court declines to issue a Certificate of Appealability because the petitioner has not made "a substantial showing of a denial of a constitutional right." 28 U.S.C., sec. 2253(c)(2).
