Filing 15 ORDER, The Asst. Corp. Counsel's request [document #13] is denied. The Court will not direct the USMS to serve the amended complaint on those defts who have already been served with the original complaint. The defts who have been served shall re spond to the amended complaint by 4/14/10. The docket reflects that the USMS has been unable to serve defts "Salumaria" and "Freeman." Pursuant to Valentin v. Dinkins, 121 F.3d 72 (2d. Cir. 1997)(per curiam), the Court requests th at the Asst. Corp. Counsel provide the full names and correct service addresses for these two deft by 4/14/10. The Corp. Counsel for the City of NY need not undertake to defend or indemnify these individuals at this juncture. This Order merely provides a means by which pltff may name and properly serve these defts. (Ordered by Magistrate Judge Lois Bloom on 3/23/2010) c/m (Galeano, Sonia) |
