March 12, 2010 Opinion or Order Filing 49 MEMORANDUM AND ORDER. Following an evidentiary hearing held on March 9, 2010, this Court ruled that Mr. Lumer and his firm had good cause to move to be relieved as counsel to the Chows and that therefore they had not forfeited their charging lien for costs. The Court further noted that an opinion would follow. This Memorandum and Order constituted that opinion. Ordered by Magistrate Judge Roanne L. Mann on 3/12/2010. (Mann, Roanne)
January 15, 2010 Opinion or Order Filing 37 ORDER, Pltffs' letter 36 is deemed to constitute a motion for a determination that their former attorney has no lien on the settlement proceeds resulting from this action, an issue over which the Court may have supplemental jurisdiction. Pltff s cannot obtain this relief without mailing a copy of their letter and its attachments to their former attorney and filing an affidavit stating that they have done so. The motion is referred to Magistrate Judge Mann for such action as she deems appro priate, including, if necessary, rendering a report and recommendation. To the extent pltffs are seeking any other relief against their former attorney, they may not do so in the context of this action, but must commence a separate action for that relief in a court of appropriate jurisdiction.
