September 29, 2010 Opinion or Order Filing 27 ORDER GRANTING IN PART AND DENYING IN PART Defendant's 9 Motion to Dismiss --- For the reasons set forth in the ATTACHED WRITTEN MEMORANDUM AND ORDER, defendant's motion to dismiss the ADEA claim and Title VII claim for failure to promote is GRANTED. However, the motion is DENIED as to plaintiff's Title VII claims for a hostile work environment, denial of salary increases, demotion and termination. These causes of action survive the motion to dismiss. Accordingly, the parties shall move forward with discovery under the supervision of the Hon. Lois Bloom, U.S.M.J. The Clerk of the Court is directed to mail a copy of this Electronic Order and the Attached Written Memorandum and Order to pro se plaintiff. SO ORDERED by Judge Dora Lizette Irizarry on 9/29/2010.
