MEMORANDUM & ORDER: For the reasons set forth in the attached opinion, the Court grants in part and denies in part the City Defendants' Motion for Summary Judgment 71 . The Court denies summary judgment to Defendant Saccente on Plaintiffs Sect ion 1983 false arrest and malicious prosecution claims. The Court grants summary judgment to the City Defendants with respect to Plaintiff's negligence claim. The Court grants summary judgment to the City of New York and Defendant Haines on all claims in this action. The Court respectfully requests the Clerk of the Court to amend the caption as noted in footnote 1, and to reflect the dismissal of Defendants City of New York and Haines from this action.The parties' proposed joint pre-trial order shall be filed ninety (90) days from the date of this Order.
