April 9, 2012 Opinion or Order Filing 91 ORDER ADOPTING REPORT AND RECOMMENDATIONS: Defendants' motion for summary judgment is GRANTED as to Plaintiff's claims for conspiracy; any claims under State law; claims for malicious prosecution, and the right to a fair trial against Offic ers Lang, Deighan, and Miller; and claims against the Property Clerk. Defendants' motion for summary judgment is DENIED as to Plaintiff's due process claim against all Defendants except the Property Clerk. Plaintiff's Fourteenth Amendm ent claims, as well as all his claims against Officer Wilson, should proceed. Plaintiff's motion to expedite ruling on summary judgment, dated March 6, 2012, is deemed moot in light of this Court's ruling. Ordered by Judge William F. Kuntz, II on 4/9/2012. (Brucella, Michelle)
August 19, 2010 Opinion or Order Filing 41 ORDER: The Court held a telephone conference on 8/18/2010. The Court set 11/15/2010 as the deadline for the parties to complete all discovery. Plaintiff shall respond to defendants' outstanding discovery demands by 9/7/2010. Plaintiff orally re quested pro bono counsel. The Court denies plaintiff's request as plaintiff has not established the threshold requirement that his claim is "likely to be of substance" at this juncture. Before requesting the Court's assista nce regarding a discovery dispute, the parties must make a good faith effort to resolve the dispute with one another. If the parties intend to move for summary judgment, they shall write to Judge Garaufis by 12/6/2010 to request a pre-motion conference.
