Filing 5 MEMORANDUM AND ORDER: The Amended Complaint, filed in forma pauperis, is dismissed in its entirety. The conspiracy and civil rights violations are dismissed for failure to state a claim as set forth herein and in the Court's July Order. The diversity claim is dismissed for lack of subject matter jurisdiction. Any state law claims are dismissed without prejudice. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal. The Clerk of Court is directed to close this case. SO ORDERED. (Ordered by Judge Brian M. Cogan, on 9/22/2009) C/mailed by Chambers. (Forwarded for Judgment) (Latka-Mucha, Wieslawa) |
