August 30, 2010 Opinion or Order Filing 21 OPINION AND ORDER: Plaintiff's 11 motion for appointment of counsel, is denied because plaintiff has not made an adequate showing that appointment of counsel is warranted in this matter. For the reasons set herein, the Administrative La w Judge correctly applied the appropriate legal standards and there was substantial evidence supporting the Commissioner's decision that plaintiff was not disabled at any time through 12/31/2005. The defendant's 14 motion for judgment on the pleadings is granted and plaintiff's motion seeking reversal of the Commissioner's decision is denied. January 19, 2010 Opinion or Order Filing 12 OPINION AND ORDER: The record before the court does not warrant appointment of counsel because it is unclear whether plaintiff's claims have merit. The court grants plaintiff an extension of time until 2/15/2010 to respond to defendant's m otion. After the court reviews plaintiff's response to defendant's motion, the court will decide whether plaintiff has made an adequate showing that appointment of counsel is warranted in this matter. Plaintiff is directed to serve her resp onse papers upon the defendant by 2/15/2010, and defendant shall thereafter file the entire set of motion papers and the administrative record with the court.
