Filing 167 ORDER ADOPTING 163 REPORT AND RECOMMENDATIONS. Having overruled Plaintiff's objections to the extent they are specific and otherwise finding no clear error, the court ADOPTS the R&R in its entirety. Accordingly, Tiffany' ;s cross-motion for summary judgment is GRANTED, Plaintiff's motion for summary judgment is DENIED, and Plaintiff's NYCHRL claim is DISMISSED without prejudice pursuant to 28 U.S.C. § 1367(c)(3). In addition, though not addresse d in the R&R, Plaintiff's claims against the "John Doe" Defendants are DISMISSED without prejudice. The court certifies pursuant to 28 U.S.C. § 1915 (a)(3) that any appeal from this order would not be taken in good fa ith and therefore in forma pauperis status is denied for the purpose of an appeal.
