ORDER [ADOPTING REPORT AND RECOMMENDATION]: The Court has reviewed Judge Bloom's thorough and well-reasoned 30 Report and Recommendation ("R&R") for clear error and finds none. Accordingly, the Court ADOPTS the R&R in its e ntirety. Theard's Amended Petition for Writ of Habeas Corpus is DENIED. Because Theard has not made a substantial showing of the denial of a constitutional right, No Certificate of Appealability shall issue.
