August 10, 2012 Opinion or Order Filing 99 ORDER denying 79 Motion to Strike ; granting 82 Motion for Summary Judgment; granting in part and denying in part 91 Motion for Summary Judgment -- 1) Inter's and MCL's motions for summary judgment are granted; 2) MCL's motion for summary judgment as to Inter's cross-claims is denied as moot; and 3) Plaintiff's cross-motion for summary judgment is denied in its entirety. Responding Defendants' requests for notations of default as to Neil and Devan Patel (D oc. Entry Nos. 67, 71, 78) are denied as moot and the corresponding Clerk's entry of notation of defaults are vacated. (Doc. Entry Nos. 70, 74, 78.) The action is thus dismissed against Third Party Defendant Neil Patel. The remaining claim again st non-appearing defendant, Devan Patel, is also dismissed. Thus, Plaintiff's motion for entry of default as to D. Patel is denied as moot (Doc. Entry No. 71) and the corresponding Clerk's entry of notation of default is vacated. (Doc. Entry No. 74.)
