October 19, 2011 Opinion or Order Filing 214 OPINION & ORDER ADOPTING REPORT AND RECOMMENDATION: The Court finds that defendants' 213 objections lack merit and accepts the recommendations set forth Judge Levy's 211 Report and Recommendation dated 9/23/2011. Accordingly, defendants' 201 motion to dismiss is denied, and plaintiffs are afforded 30 days to effect service upon defendants Sandler and Wilson. SO ORDERED by Senior Judge Allyne R. October 8, 2010 Opinion or Order Filing 157 OPINION AND ORDER: Plaintiffs appeal a September 8, 2010 Order by Magistrate Judge Levy requiring plaintiffs to produce a properly executed criminal records release pursuant to NYCPL § 160.50. After carefully reviewing the parties' submissi ons and the record, this Court finds that Magistrate Judge Levy's Order was neither clearly erroneous nor contrary to law. Fileccia's 5 request to proceed in forma pauperis is denied as moot, since he has already paid the filing fee to commence this action. Plaintiff's request to have the USMS effect service of p rocess is denied as unnecessary and improper pursuant to Fed. R. Civ. P. 4(c)(3). Plaintiff's request to have this submission filed "in cameraand under seal" is also denied. To the extent plaintiff seeks the same relief in Fileccia v.
