Filing 41 MEMORANDUM & ORDER [ADOPTING REPORT AND RECOMMENDATION]: The Court adopts Magistrate Judge Bloom's 36 Report and Recommendation in its entirety and grants Defendants' motion to revoke LaRocco's IFP status pursuant to 28 U.S.C. § 1915(g). The Court has reviewed LaRocco's remaining arguments and finds them to be without merit. Accordingly, Defendants' 26 motion is granted. LaRocco's IFP status is revoked and the complaint is conditionally dismissed unl ess he pays the entire filing fee within 30 calendar days of this Order. Filing 7 MEMORANDUM AND ORDER: The Court grants plaintiff's request to proceed in forma pauperis pursuant to 28 U.S.C. § 1915, and for the reasons discussed herein, dismisses the complaint against defendants Kristin McKeo wn and the City of New York pursuant to 28 U.S.C. §§ 1915(e)(2)(B); 1915A(b). No summons shall issue as to these defendants. The Clerk of Court shall issue summonses to Detective John Jackson and Lieutenant Jim McKeown. The United States Ma rshals Service is hereby directed to serve the summonses and complaint on these defendants. A courtesy copy of the summonses and complaint shall be sent to the Corporation Counsel, Special Federal Litigation Division. It is further ORDERED that this case is referred to Magistrate Judge Bloom for all pretrial proceedings. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal.
