Filing 10 OPINION & ORDER: For the reasons stated herein, the Court finds that plaintiff has failed to state a claim on which relief may be granted; accordingly, the complaint is dismissed pursuant to 28 U.S.C.§ 1915(e)(2)(B). Plaintiff's 8 renewed application for the appointment of pro bono counsel is denied as moot. The Court certifies pursuant to 28 U. S. C. § 1915( a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal. SO ORDERED. (Ordered by Judge Allyne R. Filing 5 MEMORANDUM & ORDER: Plaintiff's 2 request to proceed in forma pauperis is granted for the purpose of this Order, but the complaint is dismissed, with leave to submit an amended complaint within 30 days of the date of this Order. Plaintiff's motions for 4 recusal and for the 3 appointment of counsel are both denied. No summons shall issue at this time, and all further proceedings shall be stayed for 30 days or until plaintiff has complied with this Order. If plainti ff fails to comply with this Order within the time allowed, judgment dismissing the complaint shall be entered.
