The Court is troubled by the statement that Capital Stack has issued a standing instruction to its counsel not to consent to reasonable extensions. The Court's view is that common courtesy requires such consent unless the party refusing it would be prejudiced. The effect of the instruction is to simply shift more issues to the Court that should be resolved by the parties themselves and thus unnecessarily waste the Court's resources. For this reason, a blanket instruction not to consent could constitute vexatious litigation and subject the party or its attorney to sanctions.
