Filing 38 MEMORANDUM AND ORDER granting in part and denying in part defendants' Motion to Dismiss for Failure to State a Claim 35 . In summary, the only remaining claims in this action are (1) plaintiffs' Section 1983 claims for unreasonable search and seizure, (2) Matthews' Section 1983 claim for malicious prosecution in connection with the use of his allegedly coerced false confession to initiate and maintain his prosecution, (3) plaintiffs' Section 1983 claims for excessive force, and (4) plaintiffs' Section 1983 claims for failure to intervene, all against the Individual Defendants. By September 19, 2012, Matthews shall have the opportunity to file an amended complaint that adequately pleads compliance with the Notice of Claim requirements for his remaining state law claims of malicious prosecution and failure to intervene, and defendants shall respond within the time prescribed by the Federal Rules of Civil Procedure. Finally, by September 26, 2012, the parties shall file a joint status report via ECF advising the court how they wish to proceed with this case, and whether a settlement conference before Magistrate Judge Mann would be beneficial.
