A certificate of appealability shall not issue as petitioner has not made a substantial showing of the denial of a constitutional right. The court certifies, pursuant to 28 U.S.C. § 1915(a), that any appeal from this judgment denying the petition would not be taken in good faith. Respondent shall serve a copy of this Memorandum and Order on petitioner and note service on the docket by December 16, 2014.
