Filing 6 MEMORANDUM AND ORDER, Pltff's request to proceed in forma pauperis pursuant to 28 USC sec. 1915 is granted solely for the purpose of this Order. However, sovereign immunity precludes this action and it is therefore DISMISSED. Pltff's compl aint is dismissed pursuant to 28 USC sec. 1915(e)(2)(B)(iii). The Court certifies pursuant to 28 USC sec. 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal. The Clerk of Court is directed to send a copy of this Order by overnight mail to Pltff pro se, and to close the case. (Ordered by Judge Roslynn R. Mauskopf on 2/16/2011) c/m by Fed-Ex Overnight to Pltff. Fwd. for Judgment. (Galeano, Sonia) |
