April 15, 2019 Opinion or Order Filing 242 MEMORANDUM AND ORDER: For the reasons set forth in the attached memorandum and order, the Court finds that the permissible scope of damages for Plaintiff Alford's claim is limited to the time period beginning January 21, 2010, and ending on the date P.A. turns eighteen years old. Plaintiff's request 241 for a status conference is GRANTED. The Court shall hold a status conference on April 26, 2019 at 2:00 p.m. in Courtroom 4H North. August 31, 2018 Opinion or Order Filing 232 ORDER ADOPTING REPORT AND RECOMMENDATION: The parties have filed no objections to Magistrate Judge Gold's July 26, 2018 Report and Recommendation on Plaintiff J.A.'s motion for settlement approval. The Court has reviewed the record and the Report and Recommendation for clear error and, finding none, hereby adopts Magistrate Judge Gold's Report and Recommendation 231 in its entirety as the opinion of this Court. Accordingly, Plaintiff J.A.'s motion 225 for settlement approval is GRANTED. SO Ordered by Judge LaShann DeArcy Hall on 8/30/2018. (Williams, Erica)
March 28, 2018 Opinion or Order Filing 213 ORDER: As set forth in the Court's March 28, 2017 Order, having addressed the parties' objections, Magistrate Judge Gold's Report and Recommendation 192 is adopted as the opinion of this Court with respect to the following: (1) Plain tiff Alford's motion for summary judgment is DENIED; (2) Defendants' motions for summary judgment on Plaintiffs' procedural due process claims are GRANTED; (3) Defendants' motions for summary judgment on Plaintiffs' substanti ve due process non-kinship placement claims are DENIED; (4) Defendants' motions for summary judgment on Plaintiffs' substantive due process quality of care claims are DENIED with respect to J.A.'s claim and GRANTED with respect to Alfo rd's claim on grounds of qualified immunity. With respect to Magistrate Judge Gold's recommendation regarding Plaintiffs' Monell claims, Defendants' motions for summary judgment are DENIED as to Defendant City with respect to Pla intiffs' § 1983 failure to change placement to kinship claim as this Court respectfully declines to adopt Magistrate Judge Gold's recommendation insofar as it limits the claim to the purported 20-day policy, and GRANTED in all other respects.
