Filing 35 ORDER ADOPTING REPORT AND RECOMMENDATIONS ; terminating 9 Motion to Dismiss; adopting Report and Recommendations as to 23 Report and Recommendations -- On June 28, 2011, the Hon. Lois Bloom, U.S. Magistrate Judge issued a Report and Recommendat ion ("R & R") recommending Plaintiff's action be dismissed, pursuant to Federal Rules of Civil Procedure 16(f) and 37(b)(2)(A)(v), for failure to comply with the court's orders. Pro se plaintiff timely objected. For the re asons set forth in the ATTACHED WRITTEN SUMMARY ORDER, the R & R is adopted in its entirety and this action is DISMISSED. Defendant's motion to dismiss is terminated as moot in light of this Order. The court certifies pursuant to 28 U.S.C. 67; 1915(a)(3) that any appeal from this Order would not be taken in good faith, and, therefore, in forma pauperis status is denied for purpose of an appeal. Coppedge v. United States, 369 U.S. 438, 44445 (1962). The Clerk of the Court is directed to mail a copy of this Electronic Order and the Attached Written Summary Order to pro se plaintiff and to close this case.
