Filing 26 ORDER granting 14 Motion to Dismiss for Lack of Jurisdiction. For the reasons set forth in the attached Memorandum and Order, defendant's motion to dismiss plaintiff's complaint for lack of subject matter jurisdiction is granted, and pla intiff's complaint is dismissed with prejudice. The Clerk of Court is requested to enter judgment in favor of defendant, to serve the pro se plaintiff with a copy of the judgment and the appeals packet, and to close this case. Defendant is fur ther respectfully requested to serve a copy of this Memorandum and Order on the pro se plaintiff and note service on this docket within three days of receiving this Memorandum and Order.
