June 14, 2013 Opinion or Order Filing 37 MEMORANDUM AND ORDER dated 6/6/13 that the Court finds that plaintiffs objections to Magistrate Judge Bloom order dated May 2,2013, are without merit. Defendants' request for a pre-motion conference is denied without prejudice. On or before Jun e 26, 2013, defendants shall make and submit to Judge Bloom a written showing of "good cause" for their failure to comply with herscheduling order of December 6, 2012. If Judge Bloom finds good cause or concludes that summary judgment is necessary in this case, defendants may renew the request for a pre-motion conference. ( Ordered by Judge Sandra L. October 1, 2012 Opinion or Order Filing 18 MEMORANDUM AND ORDER, For the reasons set forth herein, Deft's 15 Motion to Dismiss is denied without prejudice to requesting permission, at the close of discovery, to move for summary judgment pursuant to 5 USC sec. 701(a)(2) and with respec t to Pltff's compensatory damages claims. If Pltff wishes to amend his pleading to specifically allege a legal basis for awarding compensatory damages, he must request a pre-motion conference on or before 10/19/12, in accordance with Section III .A. of this Court's Individual Motion Practices and Rules. Defts' time to answer the complaint is extended to 10/26/12, and will be further extended if Pltff files a pre-motion conference request. (Ordered by Judge Sandra L.
