MEMORANDUM AND ORDER, granting Pltff's [] Motion for Leave to Proceed in forma pauperis. For the reasons discussed herein, pltff's complaint is dismissed for failure to state a claim upon which relief can be granted, with leave to file an amended complaint within 30 days. No summons shall issue at this time and all further proceedings are stayed for 30 days for pltff to comply with this Order. If pltff fails to replead within the time allowed by this Order, judgment dismissing this a ction shall enter. The Court certifies pursuant to 28 USC sec. 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal.
