October 17, 2012 Opinion or Order Filing 182 AMENDED MEMORANDUM AND ORDER granting in part 21 Motion to Dismiss: The Bank's motion to dismiss the amended complaint is granted in part by dismissing plaintiff's first claim for relief, and is denied in all other parts. The accompany ing defense motion to strike portions of the amended complaint has no merit and is denied. See, e.g., Salcer v. Envicon Equities Corp., 744 F.2d 935, 939 (2d Cir. 1984), vacated on other grounds, 478 U.S. 1015 (1986). The litigation shall proceed p romptly as directed in the court's August 22, 2012 scheduling order. No amendment of the pleadings will be permitted, since the full theory of the case for the plaintiff has been adequately presented in the amended complaint. Ordered by Judge Jack B.
