Filing 3 MEMORANDUM AND ORDER: The Court grants plaintiff's 2 request to proceed in forma pauperis pursuant to 28 U.S.C. § 1915 for the purpose of this Order, and dismisses the complaint for failure to state a claim upon which rel ief may be granted and as frivolous pursuant to 28 U.S.C. § 1915(e)(2)(b)(i). The Court notifies plaintiff that if he persists in filing frivolous or malicious actions, he may face future filing restrictions. The Court certifies pursua nt to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal.
