Filing 35 ORDER granting 16 Motion to Dismiss for Failure to State a Claim; denying 25 Motion for Default Judgment -- For the reasons set forth in the ATTACHED WRITTEN OPINION AND ORDER, the moving defendants' motion to dismiss the complaint is gra nted in its entirety. The federal claims are dismissed with prejudice and the state claim is dismissed without prejudice. Plaintiff's motion for default judgment is denied. Accordingly, the complaint is dismissed in its entirety. The Court c ertifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and, therefore, in forma pauperis status is denied for the purpose of any appeal. Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of the Court is directed to mail a copy of this Electronic Order and the Attached Written Opinion and Order to pro seplaintiff, enter judgment in favor of all defendants and to close this case.
