Filing 70 ORDER granting 56 Motion for Summary Judgment in its entirety. The Clerk of the Court is respectfully directed to enter judgment accordingly and close the case. Ordered by Magistrate Judge Steven M. Gold on 6/10/2016. (Collins, Anne) |
Filing 3 MEMORANDUM AND ORDER: Plaintiff seeks to 2 proceed in forma pauperis (IFP) pursuant to 28 U.S.C. § 1915, which permits a district court to authorize the commencement of a civil action without requiring the plaintiff to pay the statutory filing fee. Having reviewed the financial declaration submitted by the plaintiff, the Court finds that she is able to pay the filing fee required to commence this action. Accordingly, plaintiff must pay the $350 filing fee within 1 4 days of the date of this Order in order to proceed further. No summons shall issue at this time and all further proceedings shall be stayed for 14 days or until plaintiff has complied with this Order. If plaintiff fails to pay the filing fee wi thin the time allowed, the instant complaint shall be dismissed without prejudice. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and therefore IFP status is denied for the purpose of any appeal. SO ORDERED by Chief Judge Carol Bagley Amon, on 10/19/2011. C/mailed to pro se Plaintiff. (Latka-Mucha, Wieslawa) |
