Filing 4 MEMORANDUM AND ORDER, The Court grants pltff's 2 Motion for Leave to Proceed in forma pauperis solely for the purpose of this order, dismisses the complaint for lack of subject matter jurisdiction, but affords pltff the opportunity to submit an amended complaint as detailed herein. Pltff is afforded the opportunity to file an amended complaint on or before 1/6/12. No summons will issue at this time and all further proceedings will be stayed until pltff has complied with this Order, but i n no event later than 1/6/12. If pltff fails to comply with this Order within the time allowed, judgment will enter. If submitted, the amended complaint will be reviewed for compliance with this Order and for sufficiency under 28 USC sec. 1915(e)(2)( B). The Court certifies pursuant to 28 USC sec. 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma puaperis status is denied for purpose of an appeal.
