Accordingly, the action is dismissed without prejudice pursuant to 28 U.S.C. § 1915(e)(2)(B). The Clerk of Court shall close this case and enter judgment. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal. Plaintiff's 2 request to proceed in forma pauperis pursuant to 28 U.S.C. § 1915 is granted solely for the purpose of this order, with leave to replead within 30 days. Accordingly, the complaint fil ed in forma pauperis is dismissed pursuant to 28 U.S.C. § 1915(e)(2)(B). If plaintiff fails to replead the complaint within 30 days as directed by this Order, judgment dismissing the complaint shall enter. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal.
