December 21, 2011 Opinion or Order Filing 16 MEMORANDUM DECISION AND ORDER, Based upon the rulings set forth herein, it is hereby ORDERED as follows: 1) That portion of Point I of the petition that alleges a Miranda violation and Point III of the petition are DENIED. 2) Petitioner shall show ca use within 30 days why the remaining portion of Point I (the Payton claim) is cognizable on habeas corpus review; 3) Respondent shall submit opposition to Point II of the Petition within 30 days; and 4) The parties may reply to each other's subm issions within 30 days of their respective submissions. No judgment shall enter at this time. The Court certifies pursuant to 28 USC sec. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis sta tus is denied for the purpose of an appeal. The Clerk of the Court is directed to mail a copy of this decision to petitioner pro se together with a copy of any unreported cases cited herein. (Ordered by Judge Brian M.
