Filing 3 ORDER DISMISSING CASE. For the reasons set forth in the attached Memorandum and Order, the pro se complaint, filed in forma pauperis, is dismissed for lack of subject matter jurisdiction pursuant to Federal Rule of Civil Procedure 12(h)(3), and the request for a temporary restraining order is denied. The court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal.
