July 24, 2014 Opinion or Order Filing 72 MEMORANDUM & ORDER: For the foregoing reasons, as recommended by Judge Bloom, this action is dismissed with prejudice pursuant to Fed. R. Civ. P. 37(b)(2)(A)(v) for plaintiff's failure to comply with the Court's orders to atten d her deposition. Defendant's counterclaim for conversion is likewise dismissed, but without prejudice. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal. Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of Court is directed to enter judgment and to close this case. So Ordered by Judge Eric N. Vitaliano on 7/15/2014.
