Filing 152 MEMORANDUM AND ORDER: For this reason and those articulated in the Court's December 29 Order 149 , Annan's motion for reconsideration is once again denied. Annan is advised that the Court will strike any further repetitive submissions. An nan is again cautioned against filing further voluminous, incomprehensible submissions, which will only delay the Court's efforts to advance this action to trial. Ordered by Chief Judge Carol Bagley Amon on 2/12/2016. c/m to pro se Plaintiff (Fernandez, Erica) |
Filing 149 MEMORANDUM AND ORDER: For the foregoing reasons, Annan's motions for reconsideration of the Court's September 18 Order, for enforcement of judgment pursuant to Federal Rule of Civil Procedure 70, and for sanctions pursuant to Federal Rules of Civil Procedure 11(C) and 26(g)(3) are denied. Annan is reminded that the parties are proceeding to trial. The Court has established a schedule for pretrial motions and proceedings with the goal of ensuring that Annan promptly receives his day in court. Annan is advised that further serial, voluminous filings will delay that process. If Annan wishes to make an application to the Court, he should do so once by concisely stating the relief he seeks and the grounds for the relief sought and only supplement that filing to the extent necessary to raise additional arguments or facts. Ordered by Chief Judge Carol Bagley Amon on 12/29/2015. c/m to Pro Se Plaintiff (Fernandez, Erica) |
Filing 136 MEMORANDUM AND ORDER ADOPTING REPORT AND RECOMMENDATIONS: For the foregoing reasons, the Court adopts the recommendations of the R&R. The Court therefore denies Annan's motions in their entirety and grants in part and denies in part defendants& #039; motion for summary judgment. Specifically, the Court grants summary judgment on the following claims, which are hereby dismissed: (1) all claims against the NYPD, the Missing Persons Squad, former Mayor Bloomberg, former Commissioner Kelly, and Detective Maldonado; (2) the false imprisonment claim against Officer "Albeck" or "Alback," arising from the January 23-24 incident; (4) the false imprisonment and deprivation of property claims stemming from the May 12 incident; and (5) all state law claims. The Court denies summary judgment as to the frisk claim. That claim will proceed, along with the First and Fourth Amendment claims as construed by the Court, and the January 27 claims, on which defendants did not seek summary judgment. Ordered by Chief Judge Carol Bagley Amon on 9/18/2015. (see order for details) (Fernandez, Erica) |
