Filing 35 MEMORANDUM DECISION AND ORDER: Plaintiff's failure to either allege or show, through the exhibit, that he has exhausted his administrative remedies constitutes grounds for dismissal. Because I am dismissing the complaint, there is no n eed for me to consider defendants' alternative motion for a transfer under 28 U.S.C. § 1404(a). Although plaintiff paid the filing fee to commence this action, I certify pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith, and therefore deny in forma pauperis status for the purpose of an appeal, should plaintiff seek such status.
