Filing 6 ORDER GRANTING 2 Motion for Leave to Proceed in forma pauperis and DISMISSING COMPLAINT - For the reasons set forth in the ATTACHED WRITTEN SUMMARY ORDER, plaintiff is granted in forma pauperis status for purposes of this Order and t he complaint herein is DISMISSED for lack of subject matter jurisdiction. The dismissal is without prejudice to plaintiff's pursuit of any viable claims he may have against defendants in state court. The court certifies pursuant to 28 U.S.C. & #167; 1915(a)(3) that any appeal from this Order would not be taken in good faith and, therefore, in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 44445 (1962). The Clerk of the Court is directed to mail a copy of this Electronic Order and the Attached Written Summary Order to pro se plaintiff and to close this case.
