MEMORANDUM AND ORDER, granting pltff's 2 Motion for Leave to Proceed in forma pauperis pursuant to 28 USC sec. 1915. For the reasons discussed below, the Court dismisses the complaint for failure to state a claim upon which relief may be gran ted.
