Filing 13 AMENDED ORDER [ADOPTING REPORT AND RECOMMENDATION]: This Court has received Magistrate Judge Gold's 7 Report and Recommendation ("R&R") issued 2/5/2013, recommending that the N.Y.P.D. be dismissed from this action because t he N.Y.P.D. is not a proper defendant. Plaintiff has accordingly obtained 11 leave to file an amended complaint directing her claims against the City of New York. The Court finds no error in Judge Gold's R&R and adopts it as the opinion of the Court. This Order vacates and replaces the Court's prior 12 Order of 2/27/13. SO ORDERED by Chief Judge Carol Bagley Amon, on 2/28/2013. C/mailed to pro se Plaintiff. (Latka-Mucha, Wieslawa) |
