Filing 11 ORDER DISMISSING ACTION AS FRIVOLOUS AND DENYING AS MOOT 6 Motion for TRO -- For the reasons set forth in the ATTACHED WRITTEN SUMMARY ORDER, the complaint is DISMISSED as frivolous, and, as such, Plaintiff's pending motion for a temporary r estraining order (Docket Entry No. 6) is denied as moot. Moreover, pro se Plaintiff is cautioned that the further filing of non-meritorious complaints in the U.S. District Court for the Eastern District of New York may result in the issuance of an order barring the acceptance of any future complaints for filing without first obtaining leave of court to do so. Although plaintiff paid the filing fee to bring this action, the Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any in forma pauperis appeal from this Order would not be taken in good faith. Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of the Court is directed to mail a copy of this Electronic Order and the Attached Written Summary Order to pro se Plaintiff. SO ORDERED by Judge Dora Lizette Irizarry on 4/16/2013. (Irizarry, Dora) |
